Minutes of Meeting 19th November 2001 Present: Iain Blair Ken Brown Brian Robertson Jim Coutts Ann Marston Councillor D Cameron Doreen Cameron Apologies: Alan Greig and Asti Neish Welcome: I Blair welcomed all present Minutes of the Last Meeting: Apologies to K Brown for misquoting his comments on the Knackery . This item should have read that K Brown objected to the new development, because he had received a letter from SEPA, which was a complete account of maladministration for which Dundas Brothers were going to be prosecuted. On different occasions Mr Brown had passed the Knackery and the main door had been open and there was an obnoxious smell emitting from the building. If this firm continue to have poor operative procedures can they cope with a bigger plant? Mr Brown stated that the smell had not calmed down and complaints to SEPA had risen in the past few months. Mr Brown lives approximately two miles from the Knackery. Minutes were then approved by J Coutts and seconded by K Brown. With reference to the Community Design Award, J Coutts very kindly had taken various photos of the possible nomination for this award. It was agreed that the nomination be put forward and J Coutts and I Blair to deal with this matter. Our thanks are expressed to J Coutts for all his time and expertise put into this matter. Police Matters: No police presence. I Blair is to contact Inspector Allan before the next meeting to get an update on police matters if no police are available to come to our meetings. Councillor Cameron had attended a police presentation in Fintray and Grampian Police are not giving up the office that they have at the Town House yet. Various aspects of policing were discussed, however it was a great pity that more members of the Public failed to attend this excellent presentation. Christmas Lights: Enquiries were made to Aberdeenshire Council regarding getting permanent plugs fitted to each lamppost, to enable us to fit our own lights to each lamppost, this resulted in being told that perhaps this would happen next year, but we were too late this year. Aberdeenshire Council is therefore connecting the lights this yearat a cost of £57.50 per lamppost, which we will have to pay for. I Blair to check lights before erection. And J Coutts to sign the relevant papers from the Council. Councillor Cameron agreed to contact Mr Heron regarding a Christmas tree for the Square. I Bair to contact Mr Alexander regarding the Tree Lights. Bonfire: This event was rated a complete success, with money raised at the gate amounting to £412. Our thanks are expressed to all who contributed to this total. Thanks are also echoed to all the committee who helped in any way before the event as well as after the event. I Blair has written to all relevant members of the community expressing our sincere thanks for their help in making this event a success. Barratt Development: I Blair had received a letter from the Local Government Ombudsman in Edinburgh stating that Aberdeenshire Council has replied with their comments and that we would hear about the outcome in due course. More on this matter at the next meeting. The Knackery: Councillor Cameron emphasised the fact that more residents should phone SEPA and Dundas Brothers regarding the smell that the plant is emitting. This matter is ongoing. Planning Matters: Application received for the consent for refurbishment of Offices and for formation of disabled access ramp to the Town House at Kintore. No objections to any applications J Coutts had checked the Waterside Steading Agricultural Building and found that it was already erected and was not too big. Correspondence: Letter received from the Garioch Area Forum informing us of a meeting regarding the Finances of the Forum . I Blair and D Cameron expressed an interest in attending this meeting. The Garioch Area Community Council Forum meeting has been rescheduled to take place on 12th December at 7pm. B Robertson expressed an interest to attend. AOCB: I Blair expressed a wish to compile a newsletter on the profile of the Community Council with the hope of recruiting more members. It is hoped that all aspects of the roll of the Community Council would be highlighted. Perhaps a representative from each group in the village would be invited to attend a meeting. More information on this matter at the next meeting. A Marston had been approached by two elderly members of the community to ask if the edges of the steps coming down from Henderson Crescent to the Library could be painted white as the edges of the steps are hardly visible to the visibly impaired. Councillor Cameron agreed to deal with this matter. K Brown informed us that Kintore has a new website address, which is www.kintore.org.uk. Councillor Cameron informed us that regarding the fountain in the Square the Council is awaiting lifting gear to put it into position. The drinking fountain also requires attention. Minutes of the Last Meeting Apologies to K Brown for omitting his name from the list of Community Council members . Minutes were then approved by J Coutts and seconded by B Robertson. Police Matters No police presence The Knackery Mr Ian Fowell spoke of the on going scenario regarding the obnoxious smell that the Dundas Brothers Plant omits. The proposed new development at the site would hopefully see the end of the current problem. It is proposed that the new development will use the existing residual waste to gain energy. A Neish stated that Farmyard smells are allowed, but any smell from business premises is much different in that they can be prosecuted for omitting such odours. A Neish has no objections to the proposed new development. K Brown stated that as one who lives near the plant he has no objections to the new development and no doubt things have now calmed down since the foot and mouth outbreak and lessons have been learned. Any further comment on this matter should be passed to I Blair as soon as possible. Barratt Development Forest Way This issue was first raised in January 2001. It concerns the extension of construction activities of Barratts beyond the boundaries set out in the Planning Permission and on to publicly owned land. The following points are of particular concern: 1. Residents are being denied access to parts of the amenity areas on both the northern and southern sides of the development. The south side in particular is designated a children's play area. 2. A hawthorn hedge planted some 15 years ago on the northern side as an enhancement of the amenity area has been partially removed by Barratts notwithstanding: a) The hedge is on publicly owned land beyond the boundaries of the development that are clearly set out in the documentation associated with the Grant of Planning Permission. b) A written undertaking in the original planning application that the hawthorn hedge would be retained. c) A condition of the grant of planning permission (ignored by both Barratts and Aberdeenshire Council) that before commencement of works, details of trees, shrubs and hedges to be removed are to be submitted to and approved in writing by the Planning Authority. 3. The house on the north-eastern corner of the development appears to be on, if not over the approved boundary. There is a doorway in the north face of this house and it follows that part of this property, namely the pathway to the door, will be over the boundary and on public land. 4. In his letter of 11 May 2001, the Garioch Area Manager states that "Éplanning application will be submitted and considered in due coarse" [in respect of the two amenity spaces on either side of the development]. In the five months that have elapsed since, the Community Council has not been notified of any such application. Furthermore in that time there has been a further encroachment over the boundary on the north side and more hedge has been removed. There is now a widely held view amongst those residents living in the vicinity of the development that Aberdeenshire Council is putting the interests of the developer ahead of those of the community it is supposed to be serving. Given the extent of development planned for Kintore over the next few years, the failure by Aberdeenshire Council to hold the developer to the terms and conditions attached to the Granting of Planning Permission is cause for concern. As agreed by Community Council, a complaint of maladministration by Aberdeenshire Council has been made to the Commissioner for Local Administration in Scotland (Local Government Ombudsman in Edinburgh). A representative visited the site on 13 September. We have since been advised that Aberdeenshire Council has been asked by the Commissioner to comment Within 28 days. The outcome of the maladministration has not yet arrived and we have been told that the outcome is imminent. J Coutts asked Mr Fowell why nobody seems to be held responsible for giving permission for the various applications that are submitted. Irrespective of how many objections that are raised, it seems that these objections are not even considered. Mr Fowell replied by stating that objections are considered sometimes at length by the committee. Councillor Cameron echoed this. If any Community Councillor has any further information that needs to be drawn to the planning department's attention, regarding planning applications, they are invited to voice their opinion. If any application submitted meets the necessary guidelines the planning department grants the application. Planning Matters I Blair checked the two applications for which more information was required at the last CC meeting. Bridgend Farm. (99/4748/1). Application is for 14 houses. Access would be from a point on northern road about 50 yards from Bridgend. The proposed development would extend as far as the bypass. There is still a large area (currently pasture) lying between the bypass, northern road and the proposed development, which is not included in the application. Midmill Gap Site (99/4801/1). Application is for one house. The site map shows it in the cluster of houses marked as Gwinn, Ensmore, Norland, Pinewood, Shandwick and The Neuk. I do not see any problem here. J Coutts agreed to look at the planning application for Waterside Steading Agricultural Building. The question regarding the pruning of the silver birch tree at the front of the Town House was again raised with Mr Fowell. The outcome of which was that, within reason it could be pruned to a reasonable state. Mr Fowell was also asked about the height of the fence at 41 Northern Road as to whither the height was within the approved guidelines for a front garden. . Mr Fowell did not know the full circumstances regarding this matter so did not comment. Skateboard Park A steering committee should be formed and more parents should get involved with this project. It has been agreed that the skateboarders use one of the tennis courts at the Pleasure Park. No further information has been obtained from the parents or the skateboarders involved in this project. I Blair is to write to Barratts to see if any planning gain be obtained for equipment for the proposed skateboard park. Bonfire All seems to be in order for this event. The winners of the bonfire poster competition were rewarded and our thanks are expressed for their tremendous efforts put into this annual competition. Our thanks are expressed to all who are involved in this annual event. Garden Competition J Coutts agreed to organise the photograph of the winners. Correspondence Information was received with reference to a community award for 2002 and nominations were required for this award. J Coutts agreed to look into this matter and converse with I Blair as to a possible nomination. Information was received regarding a New Opportunities in FundingSeminar. This is being held in Aberdeen. K Brown received all relevant information and agreed to pass it on to I Blair. A O C B A Neish was thanked for his work as chairman during the last two years. Members were reminded that when dealing with the press to exercise extreme caution and to make it known when opinions are only personal and not necessarily that of the Community Council. A Neish asked if the Fountain area could be cleaned up before the erection of the newly refurbished fountain. Councillor Cameron agreed to deal with this matter. K Brown stated that more information is required for the local website. Councillor Cameron stated that Aberdeenshire Council was refurbishing the Coat of Arms. B Robertson stated that an accident is waiting to happen regarding the traffic emerging from Wellpark Road onto Northern Road owing to the cars parked on Northern Road. The Roads Department is to be contacted regarding this hazard. Councillor Cameron intimated that there was a Police Presentation at Fintray village hall on5th November and urged members to attend if at all possible. I Blair is to contact Aberdeenshire Council, regarding the installation of the Christmas Lights. More details on this matter at the next meeting. Date of the next meeting 21st January 2002. Kintore Community Council Minutes of Meeting AGM 2nd October 2001 Present: Iain Blair, Brian Robertson, Doreen Cameron, Jim Coutts, Ann Marston Ken Brown Apologies: Alan Greig, Asti Neish, and Councillor Douglas Cameron. Welcome I Blair welcomed all to the AGM. Chairman's Report was not available. Treasurer's Report This was read and accepted. Minutes of last AGM Approved by D Cameron and seconded by J Coutts Election of office bearers R Alexander indicated that he no longer wished to be in the committee due to other commitments. Chairman I Blair proposed by B Robertson, seconded by J Coutts; Vice Chairman B Robertson proposed by Brown, seconded by D Cameron; Secretary A Marston proposed by J Coutts, seconded by K Brown; Treasurer D Cameron proposed by I Blair seconded by J Coutts. Community Council Committee Members: A Greig, J Coutts and A Neish Local Councillor Mr D Cameron The AGM closed and a short meeting followed. Minutes of the August meeting were approved by J Coutts and seconded by B Roberton. The chairman, I Blair, stressed that more Community Council members were needed and agreed to advertise in the local press for interested parties to come forward. Police Matters No police present. Skateboard Park D Cameron informed those present that Aberdeenshire Council had agreed to allow the youth of Kintore to use one of the tennis courts as a temporary skateboard park. It was advised that a steering committee be formed to organise various fund raising events. Knackery A proposed new development at the local Knackery could mean an end to the obnoxious smell that wafts over Kintore. I Blair had written to Malcolm Bruce MP, regarding this on going matter at the Knackery, which resulted in a meeting being held on 14th September. Various local councillors were in attendance, including SEPA and representatives from the Dundas Brothers Knackery. Several complaints were received and Dundas Brothers hoped complaints would come in the first instance to them and not directly to SEPA (Scottish Environment Protection Agency) and the HSE (Health and Safety Executive). Dundas Brothers are doing all they can at the moment to reduce the odours emanating from the plant. Wind direction is one of the factors in this ongoing matter. Further comment will be discussed at the next meeting. Bonfire This event will be held on Saturday 3rd November and not as intimated in the last minutes. J Coutts informed us that, permission has been given to allow us to use the same field as last year for the bonfire. I Blair is to contact Grampian Police to inform them of the event, and additionally the school regarding the poster competition. He also agreed to contact the local Fire Brigade regarding the fireworks. D Cameron is to check our Insurance for that night. Developments are to be discussed at the next meeting. Barratt Development This ongoing matter concerning the boundaries at the housing development at Forest Way, Kintore are no further on. We've had an acknowledgement of the fact that a breach of the boundaries has been made, but further investigation on this matter is ongoing meantime. I Blair will give us more information on this matter at the next meeting. Garioch Area Managers Visit Our Garioch Area Manager will attend our next meeting on 22nd October 2001. An agenda is to be forwarded to him before this meeting. Correspondence All correspondence distributed. Planning I Blair is to contact the planning department regarding the Bridgend Farm application and the Gap Site at Midmill application. AOCB K Brown informed us that Ken McEwen of the Kintore Website had not received the minutes of the Community Council for some months and wished to receive them regularly. A Marston is to send a copy of the latest minutes for inclusion in the Kintore Website. Next meeting at 7.30pm, Monday 22nd October 2001.

J Coutts
visited the Craigern Development in Forest Road and reported that their
wasn't room for the proposed two two-storey houses in the plot allocated.
This kind of development was out of character for the area and there was
no access road. Forest Road was already a dangerous road to negotiate
owing to all the parked cars and the fact that this road is now a recognised
bus route.
A letter
was received from Aberdeenshire Council informing us that Jan McRobbie
, the Garioch Area Forum liaison officer was leaving her post at Gordon
House and taking a post at Woodhill House. Senior Citizens Outing A few suggestions were made for the proposed outing on 2ond August. J Coutts agreed to visit a few of the proposed places and give us a full report at the next meeting
A Neish introduced Mrs Liz Tyman, who was willing to get a Kintore newsletter up and running. Mrs Tyman gave us an insight into her proposed plan of action and wished the advice and support of the Community Council. It was proposed that it would be on the same lines as the Kemnay Newsletter. Information to be included in the newsletter should be given to Mrs Tyman, who agreed to be the editor. Further details on this matter at the next meeting.
B Robertson brought up the on going matter of the lack of police presence in Kintore and the increase of vandalism. This matter will be discussed with Grampian Police at the next meeting. J Coutts also stated that he had reported an incident regarding a rifle and had waited up late to liase with the police, but no member of the force has contacted him.regarding the matter. I Blair reported that the holes in the roads around Kintore were, at last being filled in.

Raymond Alexander, Ken Brown, Cllr Douglas Cameron Welcome: A Neish welcomed all present and introduced Mr & Mrs McEwen. Minutes of the last meeting: After a few minor adjustments they were approved by J Coutts and seconded by A Neish. Police Matters: There was no police representative present. Broomhill Roundabout: This notorious roundabout was again the subject discussed. It was suggested that more warning signs be erected on the A96 to warn motorists of slow moving traffic joining the dual carriageway from the roundabout. Millennium Stone: The location of this commemorative stone is at present being discussed with the Gala committee and A Neish. The Scottish National Heritage Society has been informed of the situation. Village Fountain: The repairs of the fountain are being done as specified by the Heritage Society. Speeding Traffic: Motorists are still not observing the speed limits within the village. However after contacting the roads department of Aberdeenshire Council no money is available at present for Kintore to have traffic calming measures installed. Kintore Website: Mr Ken McEwen gave us an insight into his work on the Kintore Website. He was keen to find out about the area he had moved into and as information came available he decided that it should be made available on a website. Ken McEwen bought the KintoreScotland.co.uk website domain. Various organisations within the village can enter any matter that is of interest to the web user. Kintore parish has much more historical events of the past recorded than the actual Burgh. Pictures can also be included in the website. Any further information regarding the Kintore website can be obtained through our Community Council member Ken Brown. Correspondence: A letter was received from Aberdeenshire Council regarding the street naming and postal numbering for the new housing development at Midmill, Kintore. The name suggested by the developer was Harthill View'. The members present agreed on this name. A Marston to write a letter confirming our approval. The suggestion already made by the developer is Craigearn Business Park, Morrison Way, Midmill, Kintore. The members agreed on this name. A Marston to write a letter confirming our approval. I Blair has written to Aberdeenshire Council regarding our concerns over the breaching of boundaries of the development at Forest Way. This matter is on going and will be further discussed at the next meeting. Planning: Application to build two houses at Forest Road by Craigearn Developers. J Coutts to visit this location. No other planning applications causing concern. AOCB: Doreen Cameron mentioned the lack of privacy that the residents of Lochburn Drive have with the construction of the houses at Forest Way. A Marston to write a letter regarding this matter. R Alexander asked if the scrap cars at Midmill could be removed, as this is an unsightly approach to Kintore. This matter has been raised before and has been investigated. As this is private ground not much can be done about it. Councillor D Cameron agreed to make further enquires into this matter. Date of the next meeting 16th April 2001 at 7.30 PM. Late Announcement: A donation of £450 was received from the customers and patrons of the Kintore Arms Hotel for the senior citizens outing. J Coutts received this donation on behalf of the community council. A further donation has been promised from a local business to help with the cost of the bus for the annual outing. Our sincere thanks are expressed to all patrons and customers for this kind donation.
